Orange County Strike Cases

A “strike” is a crime that is considered either “serious” or “violent”.   The Penal Code clearly classifies which crimes are “serious” or “violent”.   Many people are confused because some crimes may seem serious to them, and when facing a criminal charge or charges, certainly one should take that very seriously and contact an experienced attorney to help.   Legally speaking, a strike is a felony that falls into the lists in Penal Code §§ 667.5(c) and 1192.7(c).   This includes among other things, Murder, Manslaughter, Mayhem, Kidnapping, Robbery, and Participation in a Criminal Street Gang, Carjacking, and Assault with a Deadly Weapon, Rape, Residential Burglary, Arson, and Criminal Threats.

Strikes affect the maximum punishment generally, as follows:   If someone has one prior strike and gets any subsequent felony (which does not necessarily have to be a strike), any sentence must be at a minimum be twice the normal punishment for the new felony.   If someone has two prior strikes and is thereafter convicted of any felony, even non-strikes, then he or she may be sentenced to 25 years to life.   Image the scenario where someone has a strike as a juvenile, like say fighting with a weapon, that causes great body harm to the victim, and this occurred while participating in a criminal street gang.   Then a few years later, the same person is caught with simple possession of less than a gram of methamphetamine, this person is facing life in prison instead of a 12 week program and a dismissal for possessing drugs.

Strike offenses also are punished more severely than other felonies in that defendants convicted of strikes must serve 85% of their prison term instead of 50% as with other non-strike felonies.
